Terms of Use

This is an English translation of the Turkish Terms of Use. If the two versions differ, the Turkish version prevails.

Baby Camera (the "App") is a service that lets parents and caregivers watch their own children from another device, using a device's camera and microphone. The camera side can be used free of charge in a web browser; to watch, at least one of the two devices needs the Baby Camera app, which is sold on the App Store. Purchases, payments and refunds of the app are subject to Apple's terms. By using the App, you agree to these terms. If you do not agree, do not use the App.

1. Purpose and permitted use

The App may only be used to watch a child of whom you are the parent or legal caregiver, in your own home or in a place where you are staying. If people other than the child (the other parent, family members, a babysitter, guests, employees, etc.) are present where the camera is, they must be informed in advance that the camera is on and must consent to it.

2. Prohibited use

Using the App for any of the following purposes is strictly prohibited:

• Using it as a hidden camera; hiding or concealing the camera, or placing it so that it is not noticed to be on.
• Watching or listening to a person, or capturing their image or voice, without their knowledge and consent.
• Watching a babysitter, cleaner, guest, tenant, employee or any other adult without their knowledge.
• Watching others in places with a high expectation of privacy, such as bathrooms, toilets or changing areas.
• Using it in a place that belongs to someone else or that you are not authorized to use it in.
• Recording the video or sound, copying it by screenshot or any other means, publishing it or sharing it with third parties (except keeping personal memories of your own child for yourself).
• Using it for harassment, stalking, blackmail, discrimination or any other unlawful purpose.

Applicable law, including the Turkish Penal Code, makes it a crime to violate the privacy of private life and to listen to or record conversations between people without consent. You are solely responsible for complying with the laws of the country you are in while using the App.

3. Camera on notice

The App shows on the camera device's screen that the camera is on and how many people are watching. This notice stays visible even when the screen is dimmed. Attempting to hide, cover or disable this notice is a breach of these terms.

4. Security of the watch link

The QR code and link on the camera screen are the key to accessing the camera. Anyone who has this link can watch the camera. Share the link only with people you trust. If you suspect the link has fallen into someone else's hands, immediately invalidate the old link with "Create new link" on the camera screen.

5. Not a medical or safety device

The App is not a medical device; it does not monitor the child's breathing, pulse or health, and it does not prevent or detect any health risk, including sudden infant death syndrome. The App is not a security or alarm system either. It does not replace the direct supervision and responsibility of an adult.

6. Uninterrupted service is not guaranteed

The App depends on the internet connection, the battery and hardware condition of the devices, browser and operating system restrictions, and third-party infrastructure services. Video and sound may be delayed, interrupted, frozen or not transmitted at all. It is not guaranteed that you will be warned every time the connection drops. Do not rely on the App alone for your child's safety.

7. Limitation of liability

The App is provided "as is", without any express or implied warranty. To the maximum extent permitted by applicable law, Artun Duzay is not liable for any direct or indirect damage arising from the use of or inability to use the App, connection interruptions, delays, errors, the watch link falling into the hands of third parties, or use of the App in breach of these terms or the law.

You alone are responsible for any claim, damage or sanction arising from your use of the App in breach of these terms or the law, and you agree to hold Artun Duzay harmless from any claims that may be brought against them for that reason.

8. Suspension of use

If a breach of these terms is suspected, access to the service may be restricted without prior notice. The service may be changed or discontinued at any time.

9. Changes

These terms may be updated. For significant changes, a notice is shown in the App and you will be asked to accept the current terms again before starting the camera.

10. Governing law

These terms are governed by the laws of the Republic of Türkiye.
